RE: The tariff classification of a furniture movers’ pad from China.

Dear Mr. Egan:

In your letter dated April 18, 2003, on behalf of Midwest Air Technologies, Inc., you requested a tariff classification ruling.

The submitted swatch is a representative sample of the material used for the manufacture of a furniture movers’ pad. The pad outer shell is made of polyester woven fabrics with needleloomed felt padding in the middle. There is stitching throughout the article creating a quilted pad. Around the edges is a woven textile fabric binding.

You have asked whether this product is subject to antidumping duties or countervailing duties. A list of AD/CVD proceedings at the Department of Commerce (DOC) and their product coverage can be obtained from the DOC website at: http://ia.ita.doc.gov, or you may write to them at the U.S. Department of Commerce, International Trade Administration, Office of Antidumping Compliance, 14th Street and Constitution Avenue, N.W. Washington, DC 20230. Written decisions regarding the scope of AD/CVD orders are issued by the Import Administration in the Department of Commerce and are separate from tariff classification and origin rulings issued by Customs.

The applicable subheading for the furniture movers’ pad will be 6307.90.9887, HTS, which provides for other made up articles . . . Other: Furniture movers’ pads of man-made fibers. The rate of duty will be 7 percent ad valorem. At the present time there are no visa or quota restrictions for articles classifiable under subheading 6307.90.9887, Harmonized Tariff Schedule of the United States (HTS), from China.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
